1. General Terms

1.1 Agreement

These Terms constitute a legally binding agreement between you ("Guest," "you," or "your") and Navipier ("Company," "we," "us," or "our"). By making a reservation or participating in any tour, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1.2 Company Information

Navipier is a Canadian tour company operating under the laws of British Columbia, Canada. Our principal place of business is located at 1525 Coal Harbour Quay, Vancouver, BC V6G 3J7, Canada.

1.3 Services

We provide guided tour services, boat excursions, and related tourism activities in and around British Columbia, Canada. All services are subject to availability, weather conditions, and safety considerations.

2. Booking and Reservations

2.1 Booking Process

Reservations may be made through our website, phone, or email. A booking is confirmed only when:

  • We receive your completed booking form and payment
  • We send you a written confirmation
  • Available capacity exists for your selected tour
  • All required information and documentation is provided
2.2 Payment Terms
  • Full Payment: Required for bookings made within 14 days of tour date
  • Deposit: 50% deposit required for advance bookings, balance due 7 days before tour
  • Group Bookings: Special payment terms apply, as outlined in separate agreements
  • Accepted Methods: Credit cards, PayPal, bank transfers, and cash (limited circumstances)
2.3 Pricing

All prices are listed in Canadian Dollars (CAD) and include applicable taxes unless otherwise specified. Prices are subject to change without notice, but confirmed bookings honor the original quoted price.

2.4 Age Requirements
  • Children under 6 must be accompanied by an adult
  • Some tours have minimum age restrictions for safety reasons
  • Parental consent required for participants under 18
  • Special rates may apply for children and seniors

3. Cancellation and Refund Policy

3.1 Guest Cancellations
  • More than 48 hours before tour: Full refund minus 5% processing fee
  • 24-48 hours before tour: 50% refund
  • Less than 24 hours before tour: No refund (except emergency circumstances)
  • No-show: No refund
3.2 Company Cancellations

We reserve the right to cancel tours due to:

  • Severe weather or unsafe conditions
  • Insufficient bookings (minimum 4 guests required)
  • Equipment failure or safety concerns
  • Force majeure events

In case of Company cancellation, guests receive a full refund or may reschedule at no additional charge.

3.3 Modifications

Tour modifications are subject to availability and may incur additional charges. We will attempt to accommodate reasonable requests but cannot guarantee specific changes.

4. Safety and Participation Requirements

4.1 Health and Fitness

Guests must be in adequate health to participate safely in tour activities. You must inform us of any medical conditions, disabilities, or special requirements that may affect your participation.

4.2 Safety Equipment
  • Life jackets are provided and must be worn when required
  • Safety briefings are mandatory for all participants
  • Guests must follow all safety instructions and guidelines
  • Failure to comply with safety requirements may result in removal from tour
4.3 Prohibited Items and Behaviors

The following are prohibited on all tours:

  • Alcohol or illegal substances (except where provided by Company)
  • Weapons or dangerous items
  • Behavior that endangers self or others
  • Harassment or discrimination of any kind
  • Damage to equipment, wildlife, or environment
4.4 Photography and Privacy

We may take photographs and videos during tours for marketing purposes. By participating, you consent to the use of your likeness in promotional materials. Guests may opt out by notifying us in writing.

5. Liability and Risk Acknowledgment

5.1 Assumption of Risk

You acknowledge that outdoor activities and boat travel involve inherent risks, including but not limited to:

  • Weather-related hazards
  • Water-based activities and marine conditions
  • Wildlife encounters
  • Physical exertion and uneven terrain
  • Equipment failure or malfunction
5.2 Limitation of Liability

To the maximum extent permitted by law, Navipier's liability is limited to the amount paid for your tour. We are not liable for:

  • Indirect, consequential, or punitive damages
  • Personal injury or property damage (except where caused by our negligence)
  • Travel delays, missed connections, or accommodation issues
  • Loss of personal items or equipment
  • Acts of nature, terrorism, or other force majeure events
5.3 Insurance

We maintain comprehensive commercial liability insurance. We strongly recommend that guests obtain travel insurance to cover personal injury, trip cancellation, and personal belongings.

5.4 Medical Emergency

In case of medical emergency, we will provide reasonable assistance, but guests are responsible for all medical costs and evacuation expenses.

6. Guest Responsibilities

6.1 Accurate Information

Guests must provide accurate and complete information when booking, including:

  • Contact details and emergency contacts
  • Medical conditions and dietary restrictions
  • Experience level and swimming ability
  • Special accommodation needs
6.2 Punctuality

Guests must arrive at the designated meeting point at the specified time. Late arrivals may result in missed tours without refund.

6.3 Equipment and Belongings

Guests are responsible for their personal belongings. We recommend leaving valuables at home and bringing only necessary items in waterproof bags.

6.4 Environmental Respect

Guests must respect the natural environment, wildlife, and local communities. This includes following Leave No Trace principles and respecting indigenous cultural sites.

7. Weather and Force Majeure

7.1 Weather Policy

Tours operate in various weather conditions, including light rain. Tours may be cancelled or modified for severe weather, including:

  • High winds or storm conditions
  • Lightning or severe thunderstorms
  • Dense fog affecting visibility
  • Extreme temperatures posing safety risks
7.2 Force Majeure

Neither party is liable for delays or failures due to circumstances beyond reasonable control, including natural disasters, government actions, labor disputes, or public health emergencies.

8. Privacy and Data Protection

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By agreeing to these Terms, you also agree to our Privacy Policy.

9. Intellectual Property

9.1 Company Property

All content on our website, including text, images, logos, and videos, is owned by Navipier and protected by copyright and trademark laws.

9.2 Guest Content

By sharing photos, reviews, or other content related to our services, you grant us a non-exclusive license to use such content for marketing purposes.

10. Dispute Resolution

10.1 Governing Law

These Terms are governed by the laws of British Columbia, Canada, without regard to conflict of law principles.

10.2 Dispute Resolution Process
  1. Direct Communication: Attempt to resolve disputes through direct communication with our management
  2. Mediation: If direct resolution fails, disputes will be submitted to mediation
  3. Arbitration: Unresolved disputes will be settled through binding arbitration in Vancouver, BC
10.3 Limitation Period

Any claim must be brought within one (1) year of the date the claim arose or it will be forever barred.

11. Special Provisions

11.1 Group Tours

Special terms apply to group bookings (15+ people) and will be outlined in separate group agreements.

11.2 Private Charters

Private charter services are subject to additional terms and conditions specified in charter agreements.

11.3 Gift Certificates

Gift certificates are valid for one year from purchase date and are non-refundable. They may be transferred to another person but cannot be redeemed for cash.

We strive to accommodate guests with disabilities and special needs. Please contact us in advance to discuss specific requirements and determine the best tour options for your needs.

13. Communication and Notices

Official communications will be sent to the email address provided during booking. Guests are responsible for monitoring email and checking for tour updates or changes.

14. Severability and Modifications

14.1 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14.2 Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on our website and take effect immediately for new bookings. Existing bookings remain subject to the Terms in effect at the time of booking.
